BOC-3 Filing

A BOC-3 (Designation of Agents for Service of Process — Motor Carriers, Brokers and Freight Forwarders) designates a legal process agent in every U.S. state to receive legal documents on a company's behalf.

**When It's Required** FMCSA requires an active BOC-3 on file before granting operating authority (MC Number). Carriers applying for for-hire motor carrier authority must have a BOC-3 designation in place. Without it, the authority application will be denied and the carrier cannot legally operate as a for-hire carrier.

**Who Must File** Any entity applying for or holding motor carrier operating authority (MC Number), freight broker authority, or freight forwarder authority. If authority has lapsed or a new entity is forming, a new BOC-3 filing is required.

**Coverage** The filing designates an authorized process agent network covering all 48 contiguous states plus Washington D.C. Alaska and Hawaii require separate coverage.

**Duration** A BOC-3 does not expire. Once filed, it remains in effect unless cancelled or superseded. However, if a carrier changes its legal name or business structure, a new filing may be required.
